Although the magistrate was entitled to prefer prosecution witnesses and was not required to set out his mental processes in detail, the appellate court, applying the 'lurking doubt' test to the whole record (including injuries, discrepancies and absence of medical evidence), found the conviction unsafe and quashed it.
