The Tribunal held that the DMC did not itself fix management contributions with sufficient certainty to displace the statutory scheme; the management company was entitled to consider GFA but could reject it and apportion Part A expenses by reference to undivided shares consistent with the Building Management Ordinance; the manager's budget and apportionment were lawful and the application was dismissed.
