- HCMA13/2025
Given the appellant's lack of legal representation at plea and sentencing, her repeated assertions that she was deceived and may not have fully understood the charges, and applying the Chan principle that the court may permit withdrawal of a plea between conviction and sentence where justice requires, the court concluded the plea may not have been a deliberate and informed decision. In the interests of justice the court exercised its discretion to allow withdrawal of the plea, quashed the conviction and remitted the case to another magistrate for fresh pleading and further proceedings.
