The application was dismissed because Ming An sought post-judgment interest against the Hotel before a final judgment had been entered against the Hotel, sought an interest remedy beyond what the assignors could have claimed, declined to bring a restitution claim which would have been the appropriate remedy to recover amounts paid, and the court declined to exercise its discretion under s48(3) to backdate interest to the judgment against Lo; accordingly Ming An cannot recover the claimed post-judgment interest.
