Despite severe adverse findings against the defendant, indemnity costs were not justified because the equitable compensation awarded on a wilful default basis adequately neutralised the effects of the defendant's breaches and both parties contributed to the length and complexity of the litigation; therefore the order nisi was made absolute with costs to be taxed on a party and party basis and the plaintiff's application for indemnity costs was refused.
