Magistrate's factual findings were supported by the evidence and therefore convictions for dangerous driving and disobeying a traffic signal were upheld; however, because the appellant was not given an opportunity to plead mitigation and the 12‑month driving disqualification unjustly impacted his livelihood and was not compulsory, the disqualification was removed and his licence endorsed instead.
