The notice served under section 733 was legally inadequate because it failed to provide sufficient details and particulars for complaints (a)–(c), such that the directors could not make a properly informed decision; the notice was, however, adequate in respect of complaint (d) (refusal to accept applicant's loan), and leave to commence a derivative action is confined to that complaint; the court retains power to grant dispensation of the notice requirement under section 733(1)(c) prior to grant of leave.
