There was an arguable case that the bankrupt retained an interest in the overseas property and by executing the 2004 deed without informing the Official Receiver he fell short of the duty to co-operate and engaged in unsatisfactory conduct under s30A(4)(c) and (d); accordingly the court exercised its discretion to suspend the automatic discharge for 9 months and awarded costs to the Official Receiver.
