The magistrate was entitled under current legislation (including the Detention Centre Ordinance) to impose detention centre orders on this young offender; section 44(3) does not require minimum disqualification periods imposed under the same provision (s44(2)) to be ordered consecutively as if they were disqualifications ordered under a different provision; given the appellant's serious and repeated breaches (including offending on bail) the magistrate's exercise of sentencing discretion and the aggregate disqualification imposed were appropriate; the appeal is dismissed.
