The magistrate did have jurisdiction under s69(1)(a) to impose a disqualification order for the offence under s42(3), but he did not properly exercise his discretion in doing so on the facts of this case; consequently the disqualification order was quashed while the fine was upheld.

The three year disqualification previously imposed under s.44(2)(b) was ultra vires because the appellant had no prior s.44 disqualification; therefore he was not lawfully disqualified at the time of the later offences and the convictions and sentences arising from that state were unsustainable and must be set aside.

Leave to apply for judicial review was refused because the magistrate had made no final determination on disqualification and the applicant had an adequate alternative remedy by appeal; no exceptional circumstances were shown to justify bypassing the appellate route.
