The court accepted that the District Court has jurisdiction to hear 'pure' title cases under DCO s.36 but exercised its discretion on costs: because the severance issue raised a complex point of law of general importance and no valid objection was raised by the defendant to High Court costs, the Court of First Instance was justified in awarding costs on the High Court scale; accordingly the earlier costs order nisi was made absolute and the summons to vary it was dismissed.
