Bindingly, relying on A.G. v. Yeung Sun-shun, the Court of Appeal concluded that it lacked jurisdiction under s84(c)(ii) to direct that the trial be resumed after an acquittal entered once the defence case had been heard; consequently the prior remit order was dehors jurisdiction and the Court must itself record the conviction and proceed to sentence, while applying s12(1) and ordering consequential relief (including discharge of costs).
