The dock identifications by PW4 and PW5 were improperly admitted because no good reason was shown why an identification parade could not have been held; the magistrate placed significant weight on that improperly admitted identification evidence, rendering the conviction unsafe and requiring quashing of the conviction without ordering a retrial given the appellant had served the major part of his sentence.
