The court held the notice of severance executed by Chung Chiu was ineffective because prior to administration and assent the executors held the properties in auter droit and the requisite concurrence or vesting order (and statutory formalities) were absent; implied assent could not validate the severance in light of the statutory framework and the authorities favoring non‑vesting of beneficial title until assent or vesting order was made, therefore the survivorship rule operated and the plaintiff succeeded as sole surviving joint‑tenant.
