The court dismissed the defendant's strike out application and held the plaintiff, as director/shareholder, was entitled to inspect the particularised documents in Schedule V (subject to exclusions for items not in existence and specified exceptions) and to inspect company books and records from after Q1 2001 to present; ulterior motives were irrelevant absent clear proof of likely misuse and the defendant must file an affidavit stating which particularised documents are in the company's power, control or custody before inspection proceeds.
