Plaintiff failed to discharge the legal burden to prove the authenticity and provenance of the Disputed Agreements; significant gaps and absence of contemporaneous supporting material, unreliable witness evidence and non‑production of documents justified applying adverse inferences (the Maxim); on balance the court concluded the Disputed Agreements did not originate from the defendant and were forged, therefore the contractual claims were dismissed and costs awarded to the defendant.

The magistrate's acceptance of PW1's evidence that altered copies were received from the appellant and the finding that selective deletion could not be a mechanical error supported the only reasonable inference that the appellant himself altered the hospital notes; the appellate court found no error in those factual findings or inferences and dismissed the appeal.

The Court held the convictions were safe: the trial judge, having heard extended testimony from the accomplice (D1) and having addressed inconsistencies and credibility issues, was entitled to prefer D1's evidence and properly exercised discretion in not recalling witnesses; the applicant failed to rebut that evidence. The Court allowed the sentence appeal in part on totality grounds and reduced the aggregate term to three years by varying concurrency.
