The Court upheld the trial judge's findings: the 4 January 1993 document did not effect a novation and did not discharge the defendant; the 19 July 1994 confirmation letter was authenticated (bearing the defendant's chop), constituted acknowledgment of the debt and undermined the defendant's limitation defence; accordingly the defendant remained liable and the appeal was dismissed.
