The Court upheld the Deputy Judge's application of a 3 year starting point for burglary of occupied private rooftop premises, accepted a 3 month enhancement for the appellant's Form 8 recognizance status, and held that after a one-third guilty plea discount the resultant sentence of 26 months' imprisonment was appropriate and not manifestly excessive, therefore dismissing the appeal.
