On rehearing the court concluded beyond reasonable doubt that the appellant intentionally used the 30 cm chopper as an offensive weapon for unlawful purposes because he brandished and pointed it at police, ignored four clear warnings, and the only reasonable inference from those facts was unlawful intent; accordingly the magistrate's conviction was upheld.
