Defendant failed to establish good title because it did not satisfactorily answer several requisitions: it did not produce certified copies of title documents, did not prove due execution or produce required board resolutions, and did not rebut the presumption of resulting trust arising from the letter of nomination; the Turquand rule and the repealed s.128 Banking Ordinance did not excuse these defaults, therefore the plaintiff was entitled to rescind, return of deposits, reimbursement, interest, an equitable lien and costs.
