The plaintiff failed to prove on the balance of probabilities that the lift lobby was wet immediately before his fall or that any such wetness caused the fall; contemporaneous medical records contradicted the plaintiff's account of left‑side injuries and undermined his credibility; the defendant had a reasonable system of cleaning and patrols; accordingly the defendant did not breach its duty and the plaintiff's claim is dismissed (alternatively, if liability had been made out, contributory negligence would have reduced damages by 30%).
