The application for leave to appeal out of time was dismissed because the applicant gave an unsatisfactory explanation for a six‑week delay and the proposed appeal did not raise any arguable question of great general or public importance under section 22(1)(b) of Cap. 484; therefore it was futile to extend time or grant leave to appeal to the Court of Final Appeal.

Subject to the de minimis principle, a period of detention pending trial which results in conviction and a sentence of imprisonment is a period of 'detention pursuant to the order of any court' within s.2(4)(b) Immigration Ordinance and must be excluded from the seven years' ordinary residence; the 14 February 2006 letter did not amount to a verification application although the Director breached a duty to give more helpful guidance, the applicant failed to prove causation or real prejudice, therefore judicial review is dismissed and the deportation order stands.

The application to strike out failed because on the authorities and facts pleaded it was not plain and obvious that the claims could not succeed; architects may owe duties of care and to act fairly to contractors arising from professional/contractual proximity and foreseeable financial loss, so the pleadings disclose arguable causes of action.

Full Bench held that the applicant was not entitled to relief: the public assurance did not estop the Crown from arresting or removing him; there was no legally enforceable duty in the circumstances to apply full rules of natural justice to an illegal entrant absent a statutory right under section 8; the Director's removal order and detention under the Immigration Ordinance were lawful; writs of habeas corpus, certiorari and prohibition were refused and habeas corpus was quashed.
