The Court refused leave because the trial magistrate's factual findings that a defective grout curtain caused excessive ingress of water, that piping and soil erosion created the sinkhole, and that monitoring and remedial measures were inadequate were amply supported by the evidence; the judge on rehearing properly considered and upheld those findings, drew an irresistible inference of causation, and no arguable legal error or substantial and grave injustice was shown to justify leave to appeal.
