The court accepted expert evidence that the child suffers from Autism Spectrum Disorder (Level 1) and dysgraphia, found the child had materially improved under the mother's care and that the father posed risks due to violent behaviour, inability to cooperate, and relapse of mental illness; accordingly sole custody, care and control was awarded to the mother and access to the father limited to email once every two weeks to protect the child's best interests and respect the child's expressed wishes.
