The Plaintiff's Charging Order could not attach to the Property because Yiu's beneficial interest was converted into sale proceeds pursuant to Good Fortune's earlier Order for Sale; the sale proceeds were applied in accordance with the Order for Sale leaving no balance for the Plaintiff, title vested in subsequent purchasers free of the charging orders, and the Judgment Debt became bankruptcy debt which was discharged on Yiu's discharge; accordingly the Originating Summons seeking an order for sale was dismissed.
