The Tribunal found the EGM of 31 March 1996 validly resolved the budget of HKD 10,940,400 inclusive of mandatory works, additional works, reserved fund and consultant/legal fees; the management committee lawfully appointed the consultant after open tender and the canopy became a separate mandatory item following a subsequent Building Authority order justifying a separate tender; clerical errors in the demand notice were immaterial and did not invalidate the resolution; therefore the applicants remain liable for the outstanding contributions and their applications are dismissed.
