The charging orders did not give Citi Honour or Sino Billion any proprietary interest capable of being conveyed; the orders for sale obtained merely committed conduct of the sale to the creditors and did not effect an appointment under Trustee Ordinance s51 nor vest the judgment debtor's interest in a purchaser under s48; therefore Win Source and Winland acquired no title and lacked locus, and because the orders and judgments were obtained by collusion and fraud they were set aside.
