The deputy judge did not miscarry in refusing severance because the offences formed a coherent pattern with strong probative value making evidence cross‑admissible, the jury were adequately directed to consider each count separately and the presence of counts to which the defendant had pleaded guilty did not cause unfair prejudice given their probative necessity; accordingly leave to appeal was refused.
