The Vendor had not shown good title as at the date the Purchaser terminated because the requisitions concerning the third party 45% beneficial interest and vacant possession were not answered satisfactorily and the Family Court Order was ambiguous as to vesting or mechanism of transfer; a title that can reasonably be questioned will not be forced on a purchaser, therefore the Purchaser was entitled to rescind the Agreement and recover deposit and stamp duty with interest; costs ordered nisi to Plaintiff.
