Leave to appeal was refused because the trial judge and the Court of Appeal made concurrent factual findings that the Ng family had occupied the land continuously and exclusively for the requisite statutory period (over 12 years), the Wong family's limited, partial occupation did not defeat adverse possession, and the 1993 default judgment was not enforced and did not interrupt possession; consequently the application had no realistic prospect of success and costs were ordered on an indemnity basis.
