Defendants established continuous exclusive possession with requisite intention since at least 2011; the unenforced 2019 judgment did not interrupt that factual continuity; plaintiff was not a privy bound by the 2019 judgment (and in any event acquired title before that judgment) and res judicata (narrow and wide) therefore did not bar the adverse possession defence; accordingly the Order 113 originating summons failed and must be dismissed.
