The Court of Appeal concluded on the evidence that the applicant was an employee of the 1st respondent, reversed the judge below for failing to make that finding and awarded compensation calculated at HK$621,290.90 plus interest, with interest computation to be carried out by the applicant's solicitors.

The Court affirmed the trial judge's findings that the four deceased were within the course of their employment (supervisor was on duty; other employees were asked by management to play with a regular customer and remained because of manpower needs) and that the arson targeted the club premises so that the premises became a dangerous spot; consequently the deaths arose out of and in the course of employment under Cap.282, s5(1) (and s5(6) supports the finding in the absence of contrary evidence).

Absent an express legislative provision extending extra‑territorial application (other than Sections 29 and 30), the Employees' Compensation Ordinance, Cap.282 applies only where the employment is performed within Hong Kong; a contract stipulating performance abroad places injuries sustained abroad outside the Ordinance and the Court lacks jurisdiction.
