Court exercised discretion under s18(2) ECO to permit a five‑month extension because the delay was not inordinate, was satisfactorily explained as inadvertent oversight during active correspondence and negotiation, the Respondent's appeal had arguable merits, there was little or no demonstrated prejudice to the Applicant and the Applicant's conduct contributed to the procedural delay; consequently leave to appeal out of time was granted and ancillary orders for expert evidence and discovery were permitted.
