Court found on the evidence that a particular plank was loose due to heavy use and inadequate maintenance and that the Federation was negligent; the camp exemption clause did not expressly exclude negligence and thus did not absolve the Federation; consequently under s25(1)(b) ECO read with s3(1) CLCO the Red Cross was entitled to recover the compensation and associated costs it paid to the employee, and judgment was entered for the Plaintiff for the claimed sum which did not exceed the statutory limit.
