On the balance of probabilities the defendant assaulted the employee and that assault caused the employee's certified injuries; the plaintiffs' settlement was bona fide; by virtue of s25 ECO and s3 CLCO the plaintiffs are entitled to recover full indemnity from the defendant and a 100% contribution is just and equitable.
