Where a fixed-term contract expired and was not renewed under the same contract, that non-renewal constitutes dismissal under section 31T(1)(b) of the Employment Ordinance, and an employer's offer to renew subsequently rejected by the employee does not defeat the statutory dismissal or the employee's entitlement to long service payment; the Labour Tribunal erred in treating rejection of a renewal offer as non-dismissal.
