The Court held that s.4(1) of the Ordinance deemed a new Crown lease to have been granted on 1 July 1973, creating a new cause of action which accrued on that date; therefore the limitation period ran from 1 July 1973 and the respondent's proceedings were not statute-barred, and that adverse possession prior to 1 July 1973 which had not ripened into a possessory title did not constitute a right or encumbrance under s.4(4)(c) to which the new lease was subject.
