The District Court has jurisdiction to entertain an application for guardianship under s.8D(2)(b) of the GMO in respect of minors who are neither ordinarily resident nor present in Hong Kong; the court may only decline to exercise that jurisdiction on forum non conveniens grounds; because no PRC forum had competent jurisdiction at the time the summons was brought, the court should not decline jurisdiction and the respondent's summons challenging jurisdiction and seeking a stay is dismissed.
