The District Court has jurisdiction to order delivery of vacant possession as an incident of a settlement order under s.10(2)(e) GMO by virtue of the ancillary jurisdiction in s.48(4) DCO as applied through s.23 GMO; a right to 'use' in a settlement order entails possession and the summons seeking delivery 'forthwith' was valid; father's procedural and substantive objections and stamp duty/bank consent arguments do not excuse non‑compliance; Court granted delivery with an extended compliance period and endorsed penal notice and costs against the father.
