The application for leave to appeal is dismissed because, even if a bankrupt can sometimes be permitted to proceed in the trustee's name, such permission is conditional on provision of a full and effective indemnity and the $300,000 security ordered was insufficient; accordingly the Court of Appeal's refusal of leave was upheld.
