S 19 BMO was inapplicable because Clause 14 of the DMC did not contain a power to sell an owner's interest; absent a valid basis under s 19 or an absolute charging order (which cannot be made without giving the debtor an opportunity to show cause), the IO could not obtain an order for sale, but was entitled to an order for payment for the sums set out in the registered memorandum of charge.
