The Settlement Deed was rescinded because it was induced by fraudulent misrepresentations by the 1st Defendant's agent; the 2006/2007 assignments were sham and illegal and therefore could not transfer title to the 1st Defendant so it was not a bona fide purchaser for value without notice; accordingly the Plaintiff remained the beneficial owner of the Lands (held by the 2nd–13th Defendants on trust) and is the proper party entitled to claim and receive the compensation for the resumption under the Lands Resumption Ordinance.
