The Court held that entrapment, where it materially affected participation, must be taken into account in mitigation and that the applicant was entitled to the same entrapment discount afforded to co-defendants; accordingly leave to appeal out of time was granted and the applicant's sentence was reduced from seven to six years.

Leave to appeal against sentence granted; entrapment and impossibility of the robbery are relevant mitigation factors though not a defence; the 14-year starting point was excessive for A2, A3 and A4 on the agreed facts and their sentences were reduced to reflect guilty pleas, degrees of participation and prior records; sentences imposed were reduced to A1 9 years, A2 7 years, A3 7 years, A4 6 years.

Entrapment, while not a legal defence, is a legitimate mitigating factor at sentencing; the District Judge erred in selecting too high a starting point for the first applicant (2 years was excessive for the circumstances) and the appropriate substituted sentence for the first applicant on the uttering count is 18 months; the concurrent 12 month sentence on the possession count remains; no alteration warranted for the second applicant whose 6 month sentence is appropriate given role and record.
