The magistrate did not err in principle or quantum; given the premeditation and serious injury caused, the starting point and the three-month guilty plea discount were appropriate and the consecutive three-month sentence for escape was lawful; therefore the appeals are dismissed.

The Court held that the offence of escape from legal custody was independent of the other offences and that the magistrate's imposition of a concurrent three‑month sentence for escape was inadvertent; the sentence for escape must run consecutively to the concurrent sentences for the other offences, and the Attorney General's application is allowed.
The appeal was dismissed because escape from custody and assault on a police officer are distinct offences; given the appellant's prior convictions (including prior escape and assault) and the need to protect police, consecutive three-month sentences were warranted and not excessive.
