Extension of time to appeal was refused because the delay was significant and in part inexcusable, and the intended grounds of appeal had no real prospect of success: the court accepted the Judge's factual finding that the defendant accepted the deceased's repudiation and terminated the SPA by serving the Defence and Counterclaim on 19 October 2016, the plaintiff's unjust enrichment claim was properly allowed in the exercise of discretion and limitation did not arise; accordingly the renewed application was dismissed and costs awarded to the plaintiff.
