The Court held that on the facts a child just under ten was contributorily negligent in stepping into the road with a van some 100 feet away and moving at about 27 m.p.h., and apportioned 20% blame to the child, but the mother was not negligent in her supervision; the driver remained negligent and the owner vicariously liable, so damages are to be reduced by 20% for contributory negligence by the child.
