Defendant established the plaintiff is usually resident outside Hong Kong and produced materials permitting an inference that the plaintiff lacks sufficient Hong Kong assets; however the defendant failed to justify the quantum of security sought (HK$200,000) and produced no evidence that defending the action would generate substantial costs. Oral examination was procedurally inappropriate. On balance the requirements for ordering security were not satisfied and the interlocutory appeal is dismissed, with costs to the plaintiff.
