On the balance of probabilities the defendant's car, travelling in the inner lane, attempted to cut into the outer lane when about 20 inches from the motorcycle and the left front of the defendant's car collided with the rear part of the motorcycle; this was caused by the defendant's failure to keep a safe distance and exercise proper care when cutting lanes, and therefore the defendant was negligent and liable for the plaintiff's injuries; PSLA assessed at $105,000 and total damages awarded $114,567 with specified interest and costs orders.
