The High Court dismissed the appeal: the magistrate lawfully considered the appellant's mitigation and was entitled to infer from the large number (about 39 items) and value (HKD 9,260) of duplicated goods that the theft was not merely personal-use opportunism and involved some planning; given those facts a short immediate custodial sentence (10 days reduced to 7 for plea) was not manifestly excessive and was appropriate and proportionate.
