On the totality of the evidence the judge found the premises were primarily used for domestic purposes at all material times; the Commissioner's certificates were given little weight because they supplied no underlying facts and statutory provisions limit direct evidence from officers; applying s.51(2)(a) and s.52(1) the tenancy remained subject to Part II of Cap.7 and the plaintiff failed to prove a ground for possession under s.53(2).
